Moldova Agricultural Competitiveness Project (MACP)

Assignment Title: Legal Expert with competencies in the field of land relations and cadaster to provide support for the delimitation and registration of land at the Public Services Agency for the construction of the Animal by-Products Processing Facility

Moldova has received an Additional Financing (AF) from the International Development Association in the amount of US$15.0 million for the Moldova Agriculture Competitiveness Project (MAC-P). The AF will be used for scaling up project activities under Component 1: Enhancing Food Safety Management aimed at strengthening human, institutional, and technical capacities of the country’s food safety and quality management systems and ensuring regulatory and system compliance with sanitary and phytosanitary (SPS) standards on premium food export markets (primarily European Union [EU] and EU-aligned markets). To this end, the AF will finance a series of activities and investments aiming to establish a comprehensive, EU-compliant system for the management of animal by-products (ABPs) unintended for human consumption.

For the construction of the processing unit, one of the major tasks to be completed by the project stakeholders was to identify a plot of land that would meet certain eligibility criteria: size – at least 200 m x 120 m (2.4 ha); the plot to be located at minimum of 1500 m from residential buildings; close to utilities – electricity, water and sewerage system; access to or close to a main road; land of flat surface meeting environmental and social international and national policies, and situated at 20-30 km to close to Chisinau. Following the assessment of Government Decision no. 161/2019 on the approval of the list of state-owned land under the administration of the Public Property Agency, a plot of 96.8225 ha meeting the above-mentioned criteria has been identified. Following the scope of the project, the Ministry of Agriculture an Food Industry (MAFI) agreed to formally delimitate 2,4 ha from this plot for the construction of the ABPs processing unit and requested CAPMU to proceed with all needed support to undergo legal procedures related to plot delimitation, change of destination (if needed) and registration.

The scope of this assignment is to provide legal support to MAFI related to plot delimitation, change of destination (if needed), its registration at PSA and identification of the beneficiary of the ABPs processing facility.

Consolidated Agricultural Projects’ Management Unit (CAPMU) on behalf of MAFI now invites local individual consultants (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services.

The Local/National Consultant to be selected shall have the following qualifications:

  • University law degree. Experience in legal drafting would be an advantage.
  • Minimum seven (7) years of experience with solid knowledge of National Regulatory Framework and Land Code, development of legal documents, including Government Decisions, preferably in the area related to agricultural sector;
  • Experience in working with public authorities and other relevant stakeholders in the area related to agriculture sector;
  • Ability to articulate issues clearly (written and verbally) and recommend solutions for public authorities and policy makers;
  • Effective communication skills (Romanian language is a must);
  • Advanced computer user skills;
  • Excellent leadership, presentation and interpersonal skills.

The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” July 2016, Revised November 2017 and August 2018 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.

Individual Consultants will be selected in accordance with the „Open Competitive Selection of Individual Consultants” method set out in the above-mentioned “Procurement Regulations”.
